Cesanta Software Limited Terms of Service for Mongoose Wizard.

Mongoose Wizard (“SOFTWARE PRODUCT”) - a no-code visual tool for creating connected applications and WebUI dashboards on embedded devices. Mongoose Wizard is located at https://mongoose.ws/wizard/.

This End User License Agreement (EULA) is a legal agreement between you (either an individual or a legal entity) and Cesanta Software Limited the Author of the SOFTWARE PRODUCT identified above, which includes computer software and may include associated media and “online” or electronic documentation. By using the SOFTWARE PRODUCT, you agree to be bounded by the terms of this EULA.

If you do not agree to the terms of this EULA, do not use the SOFTWARE PRODUCT.

Software Product License

1. GRANT OF LICENSE.

EULA grants you the following rights:

SOFTWARE PRODUCT can be used online as a visual tool to create connected applications and WebUI dashboards for embedded devices.
When you click “Generate C/C++ Code” or copy the code from the “Code” tab, the downloadable code produced is based on the Mongoose Web Server library (Mongoose Library). This code is dual-licensed under the GNU General Public License v2 (GPLv2) and a Commercial License. For more details on licensing, please refer to: https://mongoose.ws/licensing.

You must comply with the license terms of the Mongoose Web Server library. This EULA does not grant you any rights to use the Mongoose Web Server library outside of the terms specified on https://mongoose.ws/licensing.

A. Usage Under GPLv2 License Terms.

The Mongoose Web Server library under the GPLv2 license is suitable for non-commercial projects, open-source projects, private use, or evaluation purposes.
When using the downloadable code generated by SOFTWARE PRODUCT under the GPLv2 license, the “Powered by Mongoose” watermark located in the bottom left corner of the generated dashboard must remain intact. Removing the “Powered by Mongoose” watermark constitutes a violation of this EULA.

B. Usage Under Commercial License Terms.

The Commercial License removes all GPLv2 restrictions and allows you to redistribute your closed-source products with the Mongoose Web Server library embedded.
When using the downloadable code produced by SOFTWARE PRODUCT under the Commercial License, the “Powered by Mongoose” watermark located in the bottom left corner of the generated dashboard may be removed.

2. RIGHTS AND LIMITATIONS.

Limitations on Reverse Engineering, Decompilation, Disassembly and change (add, delete or modify). You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

Separation of Components.

The use of the downloadable code produced by SOFTWARE PRODUCT is strictly tied to the Mongoose Web Server library. Decoupling the code from the Mongoose Web Server library and replacing its components with other software is prohibited and will result in the termination of this EULA.

Update and Maintenance.

Cesanta may make commercially reasonable updates to the SOFTWARE PRODUCT from time to time without any prior notice.

Software Transfer.

You may not transfer any of your rights under this EULA.

Termination.

Without prejudice to any other rights, Cesanta may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such an event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

3. COPYRIGHT.

All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, clipart, libraries, and examples incorporated into the SOFTWARE PRODUCT), the accompanying online materials, and any copies of the SOFTWARE PRODUCT are owned by the Cesanta. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material.

4. LIMITED WARRANTY.

NO WARRANTIES. Cesanta expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.

5. NO LIABILITY FOR DAMAGES.

In no event shall Cesanta be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if Cesanta is aware of the possibility of such damages and known defects.

6. INTELLECTUAL PROPERTY.

Intellectual Property Rights. This Agreement does not grant you any rights, whether express or implied, to any of Cesanta’s intellectual property. Cesanta owns full ownership of all Intellectual Property Rights in the SOFTWARE PRODUCT.

7. PRIVACY POLICY.

Cesanta considers data protection and privacy to be of paramount importance. We processing operations in strict compliance with the EU General Data Protection Regulation (“GDPR”) (specifically but not limited to Article 6(1)(b) to (f) and Article 28) as well as the Laws of Republic of Ireland (together the “Applicable Law”), where Cesanta is incorporated. We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information.
